Amazon Brand Registry Cost
The Amazon Brand Registry is a program that Amazon offers to brands that wish to operate on its e-commerce platform. It gives sellers access to a range of additional features designed to help registered sellers protect their intellectual properties and manage their brand presence on the Amazon marketplace. While the additional functionalities and protection of the Amazon Brand Registry are of benefit to sellers, it is helpful to understand what costs may be associated with it and where additional assistance may be required before attempting to enroll in the program.
What does it cost sellers to use the Amazon Brand Registry?
Amazon does not charge sellers to enroll in its Brand Registry program. Brands that are eligible to use it can submit an application at no cost. Those whose applications are accepted will be granted access to all of the program’s additional features, which they may also use free of charge. However, while sellers do not have to pay Amazon to use the program, there is still a cost for sellers due to its eligibility requirements.
While the Amazon Brand Registry itself is free, brands are only permitted to use it if they own an active registered trademark in the country in which they plan to enroll. This means that before a seller can join the Brand Registry, they must pay fees to complete the trademark registration process with their jurisdiction’s trademark authority, in addition to any legal fees.
In the USA, the relevant authority is the United States Patent and Trademark Office (USPTO), whose base fee is $350, however, costs vary between trademarking authorities. Additional fees may be incurred during the trademarking process depending on the nature of the application, such as if further information and documentation are required.
Are there legal costs associated with enrolling in the Amazon Brand Registry?
There may or may not be legal costs associated with enrolling in the Amazon Brand Registry. This will depend on the seller’s specific circumstances, the nature of their application process, and the degree of legal assistance they require.
When a seller submits their trademark registration through a reputable IP law firm, that film will also handle their Brand Registry application at no additional cost. If the seller already owns a trademark and requires assistance submitting a Brand Registry application for the first time, then they may need to pay a fee for this service, though the cost is usually not high – approximately several hundred dollars, in most cases.
Where a seller has already submitted a Brand Registry application and had their submission rejected, they may also ask a law firm to assist with their re-application. These instances are usually assessed by law firms on a case-by-case basis, and the cost associated will depend on factors that contribute to the complexity and labor-intensiveness of the process, such as the reason for the rejection and severity of the issue.
